1. General Terms

• These Terms & Conditions apply to all bookings made directly through our website or official communication channels (email, WhatsApp, etc.).
• By using our website or services, you confirm that you are at least 18 years old and legally eligible to enter into a binding agreement.

2. Reservation Policy

• Bookings are confirmed only upon receipt of minimum 50% advance payment.
• The balance amount is payable at check-in, unless otherwise specified.
• All booking confirmations will be sent via email or WhatsApp.
• We reserve the right to reject any booking request without assigning a reason.

3. Check-In / Check-Out

• Check-in time: 2:00 PM
• Check-out time: 11:00 AM
• Early check-in or late check-out is subject to availability and may incur additional charges.

4. Cancellation & Refunds

• Cancellations and refunds are subject to our Cancellation Policy (see separate page).
• No refund will be provided for no-shows or early departures.
• Refunds will be processed to the original payment method within 7–10 business days, excluding gateway charges.

5. Guest Conduct

Guests are expected to:

• Maintain decorum and avoid creating disturbance to other guests.
• Respect the resort property and amenities.
• Abide by all safety instructions and guidelines provided by resort staff.
• Refrain from bringing illegal substances or engaging in unlawful activities on premises.

We reserve the right to remove any guest violating these terms, without refund.

6. Property Damage & Liability

• Guests are responsible for any loss or damage to resort property caused by them or their companions.
• In case of damage, the cost of repair or replacement will be billed at the time of check-out.

7. Children Policy

• Children of all ages are welcome.
• Guests are responsible for supervising children at all times during their stay.

8. Pets Policy

• Pets are not allowed unless prior approval has been obtained in writing.
• Approved pets must be leashed and are not permitted in common dining areas or swimming pools.

9. Use of Website

By using our website, you agree not to:

• Post or transmit false, misleading, or harmful content.
• Attempt to gain unauthorized access to our systems.
• Reproduce or copy content from our website without written consent.

All content, images, logos, and information on the website are the property of Valayada Gardens and protected under applicable copyright laws.

10. Force Majeure

We are not liable for failure to perform any of our obligations due to circumstances beyond our control including but not limited to: natural disasters, political unrest, travel bans, government regulations, pandemics, or any act of God.

11. Privacy

All personal data is handled in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your data as described therein.

12. Third-Party Links

Our website may include links to third-party platforms or booking services. We are not responsible for the content or data handling practices of these external sites.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the jurisdiction of courts located in Calicut, Kerala.

14. Amendments

We reserve the right to modify these Terms & Conditions at any time. Updated versions will be posted on this page with the latest revision date. Continued use of our services after such changes constitutes your agreement to the new terms.
